  • 外傭保險

    根據香港政府法例規定,僱主需於外傭到港當日替其購買勞工保險。另亦建議僱主替其外傭購買醫療保險,使外傭需在受聘期內提供免費醫療,包括支付門診、住院及牙科等診症費用,確保安心。
  • 工作地點

    工作地點只限由僱主與外傭所訂明在合約上的地址工作。
  • 外傭假期

    僱主需安排每星期最少一天休息日。另外,外傭做滿三個月可享有每年十二天的法定假期(元旦日、清明節、中秋節等),如法定假期適逢是外傭的休息日,僱主須另作替補予外傭。當外傭為僱主連續工作滿一年後,可享有有薪年假。
  • 終止合約

    僱傭合約期為兩年,當合約即將屆滿時,僱主需預早跟外傭傾談續約事宜,以及計算外傭應有之有薪假期。如僱傭雙方選擇續約,僱主需支付外傭來回機票之費用;如不續約,僱主則需提前一個月通知外傭,另需付外傭返回原居地之單程機票費用。根據勞工法例,若僱主或外傭欲解除僱傭合約,均需給予一個月通知期或一個月代通知金予對方。此外,僱主需提供單程機票給外傭返回原居地。
  • 回程機票

    在任何情況下,僱主均需替家傭購買返回當地的回程機票,包括海外聘請/本地聘請/自選聘請/終止合約/完結合約。對於續約家傭,僱主則需提供雙程機票給家傭(離港+到港)。此外,僱主需給予家傭每天HK$100津貼,作為離港車費及膳食津貼,性質跟當日家傭由原居地到港的情形一樣。假如家傭不幸在港逝世,僱主需負責運送其遺體及遺物返國之一切費用。
  • 遣散費及長期服務金

    僱主須付遣散費,如家傭在遭解僱前,為僱主工作不少於24個月;以及她因裁員而被解僱,或在僱傭合約屆滿後,因裁員為由而未獲續約。而長期服務金指若外傭與同一僱主連續服務滿5年或以上,當僱主解除合約或不再與外傭續約,僱主需支付長期服務金。




申請條件

香港永久居民或持有公司機構聘用合約,証明僱主受聘於香港工作。

所需文件

  1. 僱主身分證副本
  2. 入息証明,請選擇其中一種:
    • 每月薪金HK$15,000或以上(必須連續3個月銀行轉賬記錄)
    • 最近期之稅單副本(年薪HK$180,000或以上)
    • 最近6個月之定期/活期存款副本(HK$360,000或以上)
    • 銀行信正本,列明申請人之年薪。
          如僱主未能提供入息證明,可由其他家庭成員提供
    • 結婚證書副本(夫婦關係:如遺失結婚證書,可用小孩出世紙以證明夫婦關係)
    • 出世紙副本(父母與子女關係)
    • 出世紙副本(兄弟關係)

  3. 地址証明
    • 最近三個月之差餉、水費、電費、煤氣費、固網電話單、有線電視、家居寬頻(可用配偶名字,但需提供結婚証明)
    • 如居住公屋請提供房署之証明文件(亦需提交房署信及照片)

  4. 家庭成員資料
    • 英文全名、出生日期及身份證號碼(護照號碼或出世紙號碼亦可)

  5. 保證書
    • 如申請人欲替父母或家人聘請外傭,則需出示家庭成員關係證明書及附加一份保證書,保證會代為支付有關支出

  6. 如家中已有聘用工人
    • 影印家傭身分證、合約及護照

Employer Responsibilities

  • Foreign domestic helper insurance

    According to Hong Kong government regulations, employers are required to purchase labor insurance for foreign domestic helpers on the day they arrive in Hong Kong. It is also recommended that employers purchase medical insurance for their foreign domestic helpers, so that the foreign domestic helpers are required to provide free medical care during their employment period, including paying for outpatient, hospitalization, dental and other medical expenses to ensure peace of mind.

  • Work place

    The working location is limited to the address specified in the contract between the employer and the foreign domestic helper.

  • Holidays for foreign domestic helpers

    Employers are required to arrange at least one rest day per week. In addition, foreign domestic helpers who have worked for three months are entitled to 12 days of statutory holidays every year (New Year's Day, Qingming Festival, Mid-Autumn Festival, etc.). If the statutory holidays fall on the foreign domestic helpers' rest days, the employer must make a substitute for the foreign domestic helpers. When a foreign domestic helper has worked continuously for the employer for one year, she can enjoy paid annual leave.

  • Termination of contract

    The employment contract lasts for two years. When the contract is about to expire, the employer needs to discuss contract renewal with the foreign domestic helper in advance and calculate the paid holidays that the foreign domestic helper should take. If both parties choose to renew the contract, the employer needs to pay for the foreign helper's round-trip air ticket. If the contract is not renewed, the employer must notify the foreign helper one month in advance and pay for the one-way air ticket for the foreign helper to return to her place of origin.According to labor laws, if the employer or the foreign domestic helper wants to terminate the employment contract, they must give the other party one month's notice period or one month's payment in lieu of notice. In addition, employers are required to provide one-way air tickets for foreign domestic helpers to return to their place of origin.

  • Return fight ticket

    In any case, the employer is required to purchase a return ticket for the domestic helper to return to the local area, including overseas hiring/local hiring/optional hiring/contract termination/contract completion. For domestic helpers whose contract is renewed, the employer needs to provide the domestic helper with a round-trip air ticket (departure + arrival). In addition, the employer is required to provide the domestic helper with a daily allowance of HK$100 as a departure fare and meal allowance, which is of the same nature as if the domestic helper arrives in Hong Kong from the place of origin on the same day.If a domestic helper unfortunately dies in Hong Kong, the employer will be responsible for all costs of transporting the remains and belongings back to the country.

  • Severance pay and long service payment

    The employer is required to pay severance pay if the domestic helper worked for the employer for not less than 24 months before being dismissed; and if she was dismissed due to redundancy, or after the expiration of the employment contract, the contract was not renewed due to redundancy. Long-term service payment means that if a foreign domestic helper has served the same employer for five consecutive years or more, the employer needs to pay long-term service payment when the employer terminates the contract or does not renew the contract with the foreign domestic helper.

Application conditions

Hong Kong permanent residents or hold an employment contract with a company to prove that the employer is employed in Hong Kong.

  1. Copy of employer's ID card

  2. Proof of income, please choose one of the following:
    • Monthly salary HK$15,000 or above (must have bank transfer records for 3 consecutive months)
    • Copy of latest tax return (annual salary HK$180,000 or above)
    • Copies of time/current deposits in the last 6 months (HK$360,000 or above)
    • Original bank letter stating the applicant’s annual salary.
          If the employer cannot provide proof of income, other family members can provide it
    • Copy of marriage certificate (relationship between husband and wife: if the marriage certificate is lost, the birth certificate of the child can be used to prove the relationship between husband and wife)
    • Copy of birth certificate (relationship between parents and children)
    • Copy of birth certificate (brother relationship)

  3. Proof of address
    • Rates, water bills, electricity bills, gas bills, landline phone bills, cable TV, and home broadband in the past three months (spouse’s name can be used, but marriage certificate is required)
    • If you live in public housing, please provide supporting documents from the Housing Department (a letter and photos from the Housing Department are also required)

  4. Family member information
    • Full name in English, date of birth and ID number (passport number or birth certificate number is also acceptable)

  5. Letter of Guarantee
    • If the applicant wants to hire a foreign domestic helper for his or her parents or family members, he/she needs to present a certificate of family relationship and attach a letter of guarantee that the relevant expenses will be paid on his or her behalf.

  6. If there is already a hired worker at home
    • Photocopy the domestic helper’s ID card, contract and passport
